1. Definition of Deen

  • Meaning: Deen is a complete way of life covering beliefs, worship, morals, and laws in Islam.
  • Key Aspects:
    • Authority and Ruling: Deen establishes God’s authority over all aspects of life.
    • Obedience and Submission: Followers submit to God's commands as part of their faith.
    • Punishment and Reward: Actions in Deen are associated with rewards or punishments in the afterlife.
    • Method and Habit: Deen shapes the daily habits and lifestyles of its followers.

2. Definition of Shariah

  • Shariah is the set of laws derived from Islamic teachings that govern various aspects of life.
  • Difference Between Deen and Shariah: Deen is the complete way of life, while Shariah is the legal framework within Deen.

3. Functions of Shariah

  • Legal Rulings: Shariah provides guidelines on actions categorized as:
    • Fard: Obligatory duties (e.g., prayer).
    • Mandoob: Recommended actions (e.g., charity).
    • Mubah: Permissible actions (e.g., eating specific foods).
    • Makrooh: Discouraged actions (e.g., wastefulness).
    • Haram: Prohibited actions (e.g., stealing).

4. Legal Philosophy of Shariah (Maqasid al-Shariah)

  • Purpose: The objectives of Shariah focus on protecting key aspects of human welfare:
    • Preservation of Religion: Ensuring the freedom to practice Islam.
    • Preservation of Life (Nafs): Protecting the sanctity of human life.
    • Preservation of Intellect (Aql): Encouraging education and discouraging intoxication.
    • Preservation of Lineage (Nasl): Protecting family and lineage.
    • Preservation of Property (Mal): Safeguarding individual rights to property.

5. Sources of Shariah

  • Primary Sources:
    • Quran: The main source of guidance in Islam.
    • Hadith: The recorded sayings and actions of Prophet Muhammad (PBUH).
  • Dependent Sources:
    • Ijma: Consensus of scholars on Islamic rulings.
    • Qiyas: Analogical reasoning to apply principles to new situations.
    • Ijtehad: Independent reasoning in the absence of direct guidance from primary sources.

6. Quran as a Source of Shariah

  • Description: The Quran is a preserved, miraculous book containing guidance for all aspects of life.
  • Roles of the Quran:
    • Preserved from Changes: The Quran has remained unchanged since it was revealed.
    • Miraculous Content: It provides explanations about past nations and offers a comprehensive code for living.
    • Complete Code: The Quran covers spiritual, moral, and legal instructions for believers.
